You must be at least 13 years old (or the minimum age of digital consent in your country, whichever is higher) to use the Service. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. You must provide accurate information and keep your account credentials confidential — you are responsible for all activity under your account.

You may create an account using an email address and password or a supported third-party sign-in provider. You agree not to share, sell, or transfer your account, and to notify us immediately of any unauthorized access. We may suspend or terminate accounts that violate these Terms, that are inactive for extended periods, or that we reasonably believe pose risk to the Service or other users.

Potluckr lets event organizers ("Hosts") create events and invite people ("Guests") to RSVP, sign up for dishes, and select menu items. As a Host, you are solely responsible for the events you organize, the people you invite, the accuracy of event details (date, time, location, allergens, dietary information), and for complying with all applicable laws — including obtaining any consents required to contact your Guests by email or SMS. You confirm you have permission to share each email address or phone number you upload.

As a Guest, you are responsible for the accuracy of your RSVP, the food items you commit to bring, and any allergen, hygiene, or food-safety information you disclose. Potluckr does not prepare, inspect, transport, or serve food.

Potluckr is a coordination tool only. We do not certify, verify, inspect, or guarantee that food shared at any event is safe to consume, free from allergens, prepared in compliance with food-safety laws, or accurately described. Hosts and Guests are solely responsible for safe food handling and for disclosing allergens, contamination risks, and dietary information. You consume food at your own risk. To the maximum extent permitted by law, Potluckr disclaims all liability for illness, injury, allergic reaction, or other harm arising from food consumed in connection with an event coordinated through the Service.

You agree not to, and not to allow anyone else to:

• Use the Service to send spam, phishing messages, or unsolicited commercial communications.
• Upload contact information for people who have not consented to receive event communications.
• Post content that is unlawful, harassing, hateful, defamatory, infringing, obscene, or harmful to minors.
• Impersonate any person or misrepresent your affiliation with anyone.
• Probe, scan, or test the vulnerability of the Service; bypass access controls; or scrape data without our written permission.
• Interfere with or disrupt the Service, the servers or networks it runs on, or other users.
• Use the Service to collect, store, or process sensitive personal data (such as government IDs, payment card numbers, or health records) outside what the Service is designed to handle.
• Reverse engineer, decompile, or attempt to extract source code, except where this restriction is prohibited by law.

We may remove content and suspend or terminate accounts that violate these rules, with or without notice, at our discretion.

You retain ownership of the event details, menus, messages, photos, and other content you submit to the Service ("Your Content"). You grant Potluckr a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for technical purposes such as formatting), display, and transmit Your Content solely to operate, secure, and improve the Service and to deliver it to the people you choose to share it with. You represent that you have all rights necessary to grant this license and that Your Content does not infringe any third-party rights.

By using the Service, you consent to receive transactional communications related to your events (such as account, security, and RSVP notifications). Hosts who use email or SMS invitation features are responsible for ensuring recipients have consented. SMS messages, if sent through device link handoff, are sent from your own device and subject to your carrier's terms.

Some features require a paid subscription. Fees, billing periods, and trial terms are shown at the point of purchase. Subscriptions renew automatically until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period and you keep paid access until then. We may change pricing on prospective renewals with reasonable notice.

Refunds are governed by our Refund Policy, which offers a 14-day money-back guarantee on Pro subscriptions. Payments, billing, tax, cancellation, and refund mechanics are handled by Paddle as Merchant of Record — see Paddle's Buyer Terms and Refund Policy.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

The Service integrates with third-party providers (for example, authentication, hosting, email delivery, analytics, and SMS handoff). Your use of those services is also subject to their terms and privacy policies. We are not responsible for third-party services.

The Service, including its software, design, logos, and trademarks, is owned by Potluckr or its licensors and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service in accordance with these Terms. All rights not expressly granted are reserved.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access immediately if you breach these Terms, create risk or possible legal exposure for us or others, or if we discontinue the Service. Sections that by their nature should survive termination will survive — including disclaimers, limitations of liability, indemnity, and dispute-resolution provisions.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT EVENT, FOOD, OR GUEST INFORMATION WILL BE ACCURATE OR RELIABLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POTLUCKR AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR FOR ANY ILLNESS, INJURY, OR HARM ARISING FROM FOOD CONSUMED AT AN EVENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO POTLUCKR IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.

You agree to defend, indemnify, and hold harmless Potluckr and its affiliates from any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising from: (a) Your Content; (b) your use of the Service; (c) your violation of these Terms; (d) your violation of any law or third-party right; or (e) any event you organize, attend, or in connection with which food was shared.

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. You and Potluckr agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction in those courts. Nothing in these Terms limits consumer rights that cannot be waived under applicable mandatory law of your country of residence.

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. The updated Terms take effect when posted. Your continued use of the Service after the effective date constitutes acceptance.
